They can be punished with a ruble or restrictions.
How much can you avoid paying a traffic police fine
The violator has 70 days during which he has nothing does not threaten. Of these, 10 days are given to appeal the punishment and 60 to transfer money to the state.
The term is counted from the moment when a person put his signature in the protocol or received a registered letter in the mail. If you do not pick it up, then the starting point will be the day when the document returned to the traffic police. Letters with fines are kept at the post office for seven days. That is, theoretically, this period can be added to those 70.
There is another nuance. If a person did not have the opportunity to receive a letter for reasons beyond his control (for example, the mail did not try to deliver a document and this can be proved), then he may not pay anything at all. Such a position adheres to Supreme Court. But to get this right, you have to sue.
How can they be punished for non-payment of a traffic police fine
There are two options that are not mutually exclusive.
1. Through bailiffs
If the deadline for payment of a fine left, the traffic police transfers materials about this to the bailiff service. The specialist will send the violator a resolution with a proposal to voluntarily pay off the debt. Otherwise, the fine will be collected compulsorily.
The easiest way for the bailiff is to pay attention to the debtor's accounts and withhold the required amount from there. As a rule, everyone now has one or another bank account. Added to the amount of debt performance fee. It is 7%, but not less than 1,000 rubles. Also, the bailiff can apply to the debtor's employer to withhold part of the salary in favor of the state.
If a person has no accounts, then his property can be described and sell in favor of the state or arrest, that is, deprive the right to dispose of it. In addition, unpaid fines of more than 10 thousand rubles will be the reason for the prohibition of the debtor to leave the country. Sometimes people are surprised to learn about the existence of such obstacles already at the border control at the airport.
The activity of bailiffs will largely depend on the size of the fine. Often the punishment is hundreds of rubles. Most likely, for the sake of such an amount, bailiffs will not describe a person’s TV and sofa, they have many more important things to do. That, however, will not prevent them from taking the amount of the fine from your card. Larger debts promise problems more likely now.
2. Through the court
Evasion of punishment for an administrative offense is independent administrative offense. And he can be punished in several ways:
- a fine in double the amount of the unpaid (but not less than 1,000 rubles);
- administrative arrest for up to 15 days;
- compulsory work for up to 50 hours.
The decision on punishment is made by the court. Most often, he chooses the first option, because adding money to the treasury at the expense of a fine is more useful than messing around with a person during an arrest or compulsory work. That said, it's important to understand that it's not old debt being doubled. There is a new penalty twice as much. That is, all you need to pay is already three amounts.
The article provides for administrative arrest, so that the judge can make a decision and determine the punishment only in the presence of the offender. However, a person can be brought to the court session forcibly. For example, if his stop by an employee The traffic police will find the debt.
How much traffic fines are valid
In order to recover the established amount from the violator, the bailiffs have two years. But the judge can fine for non-payment of the fine only within 90 days. If during this time the meeting did not take place, then this punishment will no longer be.
