Law firm Destra Legal has filed a class action lawsuit against Apple against 20 iPhone, Apple Watch and Mac owners in Russia. Users demand compensation for non-pecuniary damage in the amount of 10 thousand rubles. rub. for each, as well as a "proportionate reduction in the cost" of goods due to non-working ApplePay. It is on the termination of the payment service that the lawsuit is based. Users claim that they received equipment with a working Apple Pay function, and its sudden shutdown was a direct violation of consumer protection law.
The opinions of lawyers interviewed by Kommersant were divided: some believe that filing such a lawsuit is pointless, while others see some chances for a positive court decision.
For example, Artyom Barinov, Head of Savina Legal Dispute Resolution Practice, noted that the probability of winning high, since the courts are “focused on satisfying the public demand for revenge” for the departure of foreign companies.
The ApplePay service became unavailable for Russian Visa and Mastercard cards in early March, and on March 24 under restrictions hit and cards of the Mir payment system. Now ApplePay has become virtually useless.
